Social Media Compliance

A Social Media Lawyer Explains How Facebook is Being Held Responsible for Misusing User Data

Facebook and third-party applications are being held responsible for the misuse of user data and non-compliance with federal social media regulations. Facebook has dug quite the hole for itself in its abuse of social media federal regulations. After the Cambridge Analytica scandal, Zuckerberg has made attempts to at least give the appearance that he is on his knees groveling for the American public’s forgiveness and vowing to take drastic measures to be in social media compliance. It may not work.

For the relatively low sum of $5 billion, the social media giant settled with the Federal Trade Commission for its numerous privacy violations and devil may care attitude when it came to multiple social media legal risks. Facebook quickly started pointing the finger at app developers at the greatest offenders of social media law. In its agreement with the FTC, Facebook vowed to, “bring its own set of requirements for bringing oversight to app developers. It requires developers to annually certify compliance with our policies” and that developers who don’t do this will be “held accountable.” Facebook did not take their supervision duties seriously and may not be up for the task. They desperately need to hire a social media law firm and an experienced social media attorney ;)

To make matters worse, a judge recently unsealed a subpoena from the Massachusetts attorney general strongly requesting Facebook provide a list of the apps and their developers who abused their data privileges and social media law. The subpoena also requested for all Facebook’s internal communication regarding those apps and the social media legal risks they took. Facebook suspended a reported 69,000 apps made by 400 develops in the wake of the Cambridge Analytica scandal and to give the appearance of concern for upholding social media federal regulations. The criteria for suspension was failure to respond to an emailed information request. Facebook is still largely failing in passive efforts to vet developers and struggling with social media compliance.
